Basic concepts

Site Visitor - a person who came to the site without the purpose of placing an Order.

User - an individual, a visitor to the Site, accepting the terms of this Agreement and wishing to place Orders in the online store finecopter.com.

Buyer - the User who placed the Order in the online store finecopter.com.

Seller - finecopter.com.

Online store - an Internet site owned by finecopter.com, located on the Internet at finecopter.com, where the Goods offered by the Sellers for purchase are presented, as well as the terms of payment and delivery of the Goods to the Buyers .

Website - finecopter.com.

Order - a duly executed request of the Buyer for the purchase and delivery to the address specified by the Buyer / by means of self-delivery of the Goods selected on the Site.

  1. General Provisions
    1. The Seller sells the Goods through the Internet store at: finecopter.com.
    2. When ordering Goods through the Online Store, the User agrees to the terms of sale of the Goods set forth below (hereinafter referred to as the Terms of Sale of Goods). In case of disagreement with this User Agreement (hereinafter referred to as the Agreement / Public Offer), the User is obliged to immediately stop using the service and leave the site finecopter.com.
    3. These Terms of Sale of Goods, as well as information about the Goods presented on the Site, are a public offer in accordance with Art. 435 and paragraph 2 of Art. 437 of the Civil Code of the Russian Federation.
    4. The Agreement can be changed by the Seller unilaterally without notifying the User/Buyer. The new version of the Agreement comes into force after 10 (ten) calendar days from the date of its publication on the Site.
    5. The public offer is recognized as accepted by the Site Visitor / Buyer from the moment the Visitor visits the Site finecopter.com and the Buyer places an Order without authorization on the Site, as well as from the moment the Buyer accepts the Order.
    6. The retail sale contract is considered concluded from the moment the Seller issues to the Buyer a document confirming payment for the goods.
    7. By informing the Seller of his e-mail and phone number, the Site Visitor/User/Buyer agrees to the use of these means of communication by the Seller, as well as third parties involved by him for the purpose of fulfilling obligations to the Site Visitors/Users/Buyers, in order to send advertising and informational nature, containing information about discounts, upcoming and current promotions and other events of the Seller, about the transfer of the order for delivery, as well as other information directly related to the fulfillment of obligations by the Buyer under this Public Offer.
    8. By placing an Order, the User/Buyer agrees that the Seller may entrust the execution of the Agreement to a third party, while remaining responsible for its execution.
    9. All rights and obligations under the Agreement concluded with the User arise directly from the Seller, while the Buyer fully understands and agrees that if an agreement is concluded with the Seller other than finecopter.com, finecopter.com is not a party to this agreement and does not bear obligations related to its execution, except for those provided for by this Public Offer.
    10. As part of the Order, finecopter.com provides the User with information support of the Agreement concluded between the User and the Seller.
  2. Subject of the Agreement

    1. The subject of this Agreement is to provide the User with the opportunity to purchase the Goods presented in the online store catalog at finecopter.com.

    2. This Agreement applies to all types of Goods and services presented on the Site, as long as such offers with a description are present in the catalog of the online store.

  3. Product and purchase procedure
    1. The Seller ensures the availability of the Goods presented on the Site in its warehouse. The photographs accompanying the Product are merely illustrations of the Product and may differ from the actual appearance of the Product. The descriptions/characteristics accompanying the Product do not claim to be exhaustive and may contain typographical errors. To clarify information on the Goods, the Buyer must contact finecopter.com by e-mail. The information provided on the Site is updated every 30 minutes.
    2. In the absence of the Goods ordered by the Buyer in the warehouse of the Seller, the latter has the right to exclude the specified Goods from the Order / cancel the Buyers Order by notifying the Buyer by sending an appropriate electronic message to the address specified by the Buyer
    3. In case of cancellation of a fully or partially prepaid Order, the cost of the Goods is returned by the Seller to the Buyer in the manner in which the Goods were paid for.
    4. The Buyer order is executed in accordance with the procedures specified on the Site.
    5. The Buyer is fully responsible for the provision of incorrect information, which entailed the impossibility of the Seller to properly fulfill its obligations to the Buyer.
    6. After placing an Order on the Site, the Buyer is provided with information about the expected date of receipt (delivery) by sending an electronic message to the address specified by the Buyer during registration, or by phone. The Seller may clarify the details of the Order, agree on the date of receipt / delivery, which depends on the transport company, the availability of the ordered Goods in the Seller warehouse and the time required for processing and delivery of the Order.
    7. The expected date of transfer of the Order to the Delivery Service of the relevant Seller is communicated to the Buyer by e-mail or during a follow-up call to the Buyer. The date of transfer of the Goods may be changed by the Seller unilaterally if there are objective reasons, in the opinion of the Seller.
  4. Order delivery
    1. Methods, as well as approximate delivery times for the Goods sold by finecopter.com, are indicated on the Site. Specific delivery times can be agreed upon by the Buyer with the Call Center operator when confirming the order.
    2. Delays in delivery are possible due to unforeseen circumstances that occurred through no fault of the Seller.
    3. Upon delivery, the Order is handed over to the Buyer or a third party specified in the Order as a recipient (hereinafter the Buyer and the third party are referred to as the "Recipient"). If it is impossible to receive the Order paid by bank transfer by the above persons, the Order may be handed over to a person who can provide information about the Order (consignment number and / or full name of the Recipient).
    4. The risk of accidental damage to the Goods passes to the Buyer from the moment the Order is transferred to him and the Recipient of the Order affixes a signature in the documents confirming the delivery of the Order. In case of non-delivery of the Order, the Seller shall reimburse the Buyer for the cost of the Order prepaid by the Buyer and delivery in full after receiving confirmation of the loss of the Order from the Delivery Service.
    5. The cost of delivery of each Order is calculated individually, based on the ordered Goods, the weight of the Goods, the region and method of delivery, as well as (if necessary) the form of payment.
    6. The obligation of the Seller to transfer the goods to the Buyer is considered fulfilled at the moment the courier delivers the Goods to the Recipient or the Goods are received by the Recipient at the post office or at a predetermined place of issue of the Order (including at the pickup point).
    7. Upon receipt of the Order at the post office, the Recipient, after paying for the delivered Goods, is obliged to inspect the delivered Goods and open it in the presence of Russian Post employees to check the Goods for compliance with the declared quantity, assortment and completeness of the Goods, as well as check the service life of the delivered Goods and the integrity of the packaging. In the event of claims to the delivered Goods (underinvestment, insertion of the Goods other than those indicated in the inventory, manufacturing defects, other claims), at the direction of the Recipient, the employees of the Russian Post draw up a Statement of Identified Inconsistencies. If the Recipient has not filed claims in the above manner, the Seller is considered to have fully and properly fulfilled its obligation to transfer the Goods.
    8. When accepting the Order from the courier, the Recipient is obliged to inspect the delivered Goods and check it for compliance with the declared quantity, assortment and completeness of the Goods, and also check the service life of the delivered Goods and the integrity of the packaging. If there are no claims to the delivered Goods, the Recipient shall sign the Order Delivery Form or other similar document provided by the courier. The signature in the delivery documents indicates that there are no claims to the Goods by the Recipient and the Seller has fully and properly fulfilled its obligation to transfer the Goods.
    9. You can specify the date, time and, if necessary, the delivery route from the Seller, who contacts the Buyer to confirm the Order.
    10. Claims to the quality of the purchased Goods that arose after payment and receipt of the Goods are considered in accordance with the Law of the Russian Federation "On the Protection of Consumer Rights" and the warranty obligations of the relevant Seller. In this regard, the purchase of the Goods with delivery does not give the Buyer the right to demand delivery of the purchased Goods for the purpose of warranty service or replacement, does not give the opportunity to carry out warranty service or replacement of the Goods by visiting the Buyer and does not imply the possibility of returning the cost of delivery of the Goods in cases where the Buyer has the right to a refund for the Goods as such, in accordance with the Law of the Russian Federation On the Protection of Consumer Rights.
  5. Payment for goods
    1. The price of goods sold in the online store is indicated in rubles of the Russian Federation.
    2. The price of the Goods is indicated on the Site. In case of incorrect indication of the price of the Goods ordered by the Buyer, the Seller informs the Buyer about this in order to confirm the Order at the corrected price or cancel the Order. If it is impossible to contact the Buyer, this Order is considered canceled. If the Order has been paid, the Seller returns to the Buyer the amount paid for the Order in the same way it was paid.
    3. The price of the Goods on the Site can be changed by the Seller unilaterally. In this case, the price of the Goods ordered by the Buyer is not subject to change. The price of the Goods may vary by region.
    4. finecopter.com has the right to provide discounts on Goods and establish a bonus program. Types of discounts, bonuses, the procedure and conditions for accrual are determined by the Seller independently and are indicated on the Site.
    5. When carrying out marketing activities involving the investment of any objects in shipments with the Buyer Order, the delivery of these investments is carried out at the expense of the Buyer. In order to cancel the investment, the Buyer must contact the Seller.
    6. The Seller maintains statistics of orders redeemed by the Buyer. The Seller has the right to unilaterally determine the payment methods available to the relevant Buyer, based on the statistics of the actions performed by the Buyer in relations with the Seller.
    7. The order is considered incomplete if the Buyer has reported a change in the purchase decision before the start of the assembly of the order in the warehouse. If the Buyer informed the Seller about this after the moment the order was assembled at the warehouse, then such an Order is considered rejected. finecopter.com has the right to decide to block the On receipt service for the Buyer in relation to the goods sold by finecopter.com, firstly, if, in accordance with the indicated statistics, within the framework of 4 or more orders previously placed in a row, the volume of goods rejected by the Buyer more than 80 percent of the total volume of delivered goods. Secondly, if the share of incomplete orders is more than 60% of the total number of orders placed and the number of incomplete orders is at least 5. Subsequently, the Buyer will be able to use the On receipt service again only after redemption of one to three orders for a total of 5,000 rubles during three months.
    8. The Seller has the right to limit the payment methods available to the Buyer depending on the volume of previous payments. The "On receipt" payment method for goods sold by finecopter.com is not available for buyers who have placed more than 20 orders or 240 goods within 14 days, or who have confirmed more than 10 orders or 160 goods within 2 days. Seller has the right to limit other payment methods available to the Buyer at its discretion.
  6. Return of goods and funds
    1. The Buyer has the right to refuse the ordered Goods at any time before receiving it, and after receiving the Goods - within 14 days, not counting the day of purchase. The return of the Goods of good quality is possible if its presentation, consumer properties, as well as a document confirming the fact and conditions of purchase of the said Goods are preserved.
    2. If at the time of the Buyer request, a similar product is not available for sale from the Seller, the Buyer has the right to refuse to execute this Agreement and demand a refund of the amount of money paid for the specified Goods. The Seller is obliged to return the amount of money paid for the returned goods within 10 days from the date of return of the Goods.
    3. A product of inadequate quality means a product that is defective and cannot ensure the performance of its functional qualities. The received Goods must correspond to the description on the Site. The difference between the elements of design or design from the description stated on the Site is not a sign of inadequate quality.
    4. The appearance and completeness of the Goods, as well as the completeness of the entire Order must be checked by the Recipient at the time of receipt / delivery of the Goods.
    5. If the Buyer was given the Goods of inadequate quality and it was not agreed in advance by the Seller, the Buyer has the right to use the provisions of Art. 18 "Consumer rights in case of defects in the product" of the Law on the Protection of Consumer Rights.
    6. Claims for the return of the amount of money paid for the goods are subject to satisfaction within 10 days from the date of presentation of the relevant requirement (Article 22 of the Law of the Russian Federation "On Protection of Consumer Rights").
    7. Refunds are made by returning the cost of the paid Goods to a bank card or by postal order. The method must be indicated in the appropriate field of the application for the return of the Goods.
  7. Responsibility
    1. The Seller is not responsible for damage caused to the Buyer due to improper use of the Goods purchased in the Online Store.
  8. Confidentiality and information protection
    1. The personal data of the User/Buyer is processed in accordance with the Federal Law "On Personal Data" No. 152-FZ.
    2. When registering on the Site, the User provides the following information: Last name, First name, Middle name, contact phone number, email address, delivery address of the goods.
    3. By providing his personal data to the Seller, the Site Visitor/User/Buyer agrees to their processing by the Seller, including for the purpose of fulfilling the Seller obligations to the Site Visitor/User/Buyer under this Public Offer, promoting goods and services by the Seller, conducting electronic and sms surveys , monitoring the results of marketing campaigns, customer support, organizing the delivery of goods and to the Buyers, holding prize draws among the Site Visitors / Users / Buyers, monitoring the satisfaction of the Site Visitor / User / Buyer, as well as the quality of services provided by the Seller.
    4. The processing of personal data means any action (operation) or a set of actions (operations) performed with or without the use of automation tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, changing) extraction, use, transfer (including transfer to third parties, not excluding cross-border transfer, if the need for it arose in the course of fulfilling obligations), depersonalization, blocking, deletion, destruction of personal data.
    5. The Seller has the right to send information, including advertising messages, to the e-mail and mobile phone of the User / Buyer with his consent, expressed by performing actions that uniquely identify this subscriber and allow him to reliably establish his will to receive the message. The User / Buyer has the right to refuse to receive advertising and other information without explaining the reasons for the refusal by informing finecopter.com of his refusal. Service messages informing the User/Buyer about the order and the stages of its processing are sent automatically and cannot be rejected by the User/Buyer.
    6. Withdrawal of consent to the processing of personal data is carried out by withdrawing the acceptance of this Public Offer.
    7. The Seller has the right to use "cookies" technology. Cookies do not contain confidential information. The Visitor / User / Buyer hereby consents to the collection, analysis and use of cookies, including by third parties for the purposes of generating statistics and optimizing advertising messages.
    8. The Seller receives information about the ip-address of the visitor to the Site finecopter.com. This information is not used to identify the visitor.
    9. The Seller is not responsible for the information provided by the User/Buyer on the Site in a public form.
    10. The Seller has the right to record telephone conversations with the User/Buyer. At the same time, the Seller undertakes: to prevent attempts of unauthorized access to information received during telephone conversations and / or its transfer to third parties not directly related to the execution of Orders, in accordance with paragraph 4 of Art. 16 of the Federal Law "On Information, Information Technologies and Information Protection".
  9. Duration of the Agreement
    1. This Agreement comes into force from the moment of its acceptance by the Site Visitor / Buyer, and is valid until the withdrawal of acceptance of the agreement.
  10. Additional terms
    1. The Seller has the right to assign or otherwise transfer its rights and obligations arising from its relationship with the Buyer to third parties.
    2. The online store and the services provided may be temporarily partially or completely unavailable due to preventive or other work or for any other technical reasons. The finecopter.com technical service has the right to periodically carry out the necessary preventive or other work with or without prior notice to the Buyers.
    3. The provisions of Russian law apply to the relationship between the User/Buyer and the Seller.
    4. In case of questions and claims from the User/Buyer, he/she must contact the Seller by phone or in any other available way. The parties will try to resolve all disputes that arise through negotiations; if an agreement is not reached, the dispute will be referred to the judicial authority in accordance with the current legislation of the Russian Federation.
    5. Recognition by the court of the invalidity of any provision of this Agreement does not entail the invalidity of the remaining provisions.
